Q: Can the Environment Agency check private ponds?
A: Yes – the Agency can check private ponds and we are empowered to check any water where an offence is being committed or may be committed. There are a small number of exceptions to this but these can be overcome by us obtaining a warrant from the court. Anyone who prevents a bailiff from entering their fishery may be guilty of obstruction, something which could result in them being prosecuted.
